POP ART CONTEST OFFICIAL RULES
The Public Option Please Art Contest (”Contest”) commences at 12:00 p.m. (noon) EDT on October 13, 2009, and ends at 11:59 p.m. EDT on October 31st November 7th, 2009 (the “Contest Period”). Submissions may be made to the Contest during the period from and including12:01 p.m. (noon) EDT on October 13, 2009 through and including 11:59 p.m. October 31st November 7th, 2009 (the “Submission Period”). Contest is sponsored and run by Public Option Please, a nonprofit corporation (”Sponsor”).
Eligibility
1. The Contest is open only to natural persons older than 15 years of age as of the date of entry, who are U.S. citizens or legal permanent residents of the U.S. Employees, independent contractors, officers, and directors of Sponsor, The FireDogLake Company and their respective affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, and their immediate family members and persons living in the same household of such persons, are not eligible to participate in the Contest. Employees or other agents who have non-public knowledge of the plans, projects, needs and themes of the Public Option Please campaign , are not eligible to participate in the Contest. Contest offered only in the 50 United States, the District of Columbia, and U.S. military bases abroad. Void where prohibited by law.
Corporations and other legal entities are not eligible to enter.
How to Enter
2. To enter, create a piece of artwork, 2- or 3-dimensional, that exemplifies the positive themes and grassroots energy that are of the Public Option campaign (such work as created being hereinafter referred to as “Submission”). Your Submission may include or be about Healthcare Reform, the Public Option or it may merely involve the themes outlined in these Contest rules. Using the Submission Guidelines below, your Submission should be creative, memorable, and informative. The physical size of your Submission, if it is a sculpture, mobile or other 3-dimensional works, should not exceed 70 pounds; a 2-dimensional work may not be larger 60″ x 60″.
3. To submit your entry, take a digital photograph of your Submission in, or converted to, one of the following still digital image formats: JPG, GIF, or PDF. We recommend the Submission image(s) be 300dpi. No Submission image may exceed 250MB. If your Submission is 2-dimensional, you may only submit one (1) image. If your Submission is 3-dimensional, you may submit up to three (3) images .4. Then, at any time during the Submission Period, access the Public Option Please Website at www.publicoptionplease, and click on the Contest button. You will be requested to provide your full name, phone number, email address, and postal address as well as other information. Then, upload the image or images of your Submission as directed. Designate how you would like your attribution to appear (e.g., “Julie North, Los Angeles, CA” “J. North, Los Angeles, CA,” or “Julie N., Los Angeles, CA”).
5. You may enter as many Submissions as you like, but each Submission must be separately entered in accordance with these guidelines.
Additional Submission Requirements
6. Submissions must relate to the themes of Public Option, Healthcare for All, Heal Ourselves and Heal the World, Healthcare and Social Justice, Transforming the Future of Healthcare, Healthcare as a Human Right.
7. Submissions may not reference by name, or picture, or otherwise clearly identify, any specific Member of Congress or candidate for federal, state or local office.
8. No Submission may include any content, words or graphics that is defamatory, offensive or demeaning to POP’s reputation or goodwill, or otherwise not in the best interests of POP, nor may any Submission depict any harmful or illegal activity or substances, all as determined in the sole discretion of TIP.
9. Submissions must be consistent with the progressive political values of Sponsor, as determined solely by Sponsor.
10. Each Submission must be an original work of authorship. By entering the Contest, you warrant and represent that:
- your Submission is wholly original and created entirely by you and does not incorporate or include anything that is owned by any third party or entity or would require the consent of any third party or entity and that your Submission does not violate any law or the copyright, trademark, publicity right, privacy right or any other right of any third party;
- that you have obtained any necessary permissions from all relevant third parties to create, copy, publish and disseminate your Submission.
11. You may not be, nor may you in any way depict, name or refer to in your Submission, any person who is (a) represented under contract e.g., by a talent agent or manager that would limit or impair the ability of Sponsor to display, broadcast, publish or otherwise disseminate the Submission in any form or medium anywhere in the world; or (b) have an acting or modeling contract that would make his or her appearance in the Submission a violation of any third party rights; or (c) are under a merchandising agreement or (d) are under any other contractual relationship including but not limited to guild or union memberships, that may prohibit him or her from appearing in the Submission or from allowing Sponsor to display, publish, broadcast and use the Submission in any medium.
12. By entering the contest, you warrant and represent that you have obtained consent from any person appearing in, depicted in or referred to in your Submission. You will be required to furnish a signed waiver and release form from each such person upon request of TIP. Failure to furnish a signed waiver and release if and when requested by Sponsor will disqualify your Submission from consideration in the contest.
Judging Criteria and Selection of Winning Submission
13. Between 3 and 20 persons will be selected by Sponsor, in its sole discretion, to serve as the POP Art Contest Selection Committee (“Selection Committee”).
14. All Submissions will be initially screened by Sponsor for compliance with the Submission Criteria and Additional Submission Requirements and entries not complying with such criteria and requirements will be eliminated from further consideration.
15. During the period November 1 November 8 through November 3 November 10, 2009, the Selection Committee will select up to 30 finalists.
16. Images of the finalist Submissions will be posted on POP’s website and visitors to the website will be invited to vote to select the Public Choice Award (see below).
17. The Selection Committee will score each of the finalist Submissions according to the following judging criteria: Overall Impact (25% of overall grade), Originality (25% of overall grade), Positive Message (25% of overall grade), and Artistic Merit (25% of overall grade). Judges will report which finalist Submissions receives the highest 3 scores to Sponsor and the three (3) Submissions receiving the highest overall scores shall be deemed the first, second, and third prize Winning Submissions respectively (see below). In the event of a tie, the tying entries will be rescored until a winner is selected.
18. All decisions by the Selection Committee and Sponsor are final.19. Winners will be notified at or before 11:59 p.m. on November 5, 2009, using the contact information on the entry form. Sponsor is not responsible for late, lost, misdirected or unsuccessful efforts to notify winners.
Prizes
20. First Place Winner: The first prize winner will receive a cash prize of one thousand dollars ($1000.00). Posters, t-shirts and buttons of artists winning submission will be sold and distributed by P.O.P to help raise money for the “Public Option”. A black and white version of the artwork will be posted by POP on its website for free download. The original Submission will be made available for sale at an art gallery selected by POP. The winner will be entitled to retain fifty percent (50%) of the proceeds of retail sale of the Submission at the gallery less standard gallery commission and sales tax. The remaining 50% will be paid to Sponsor.
21. Second Prize Winner: The Second Prize winner will receive $750.00. Posters, t-shirts and buttons of artists winning submission will be sold and distributed on P.O.P to help raise money for the “Public Option”. A black and white version of the artwork will be posted on Sponsor’s website for free download. The original Submission will be made available for sale at an art gallery selected by POP. The winner will be entitled to retain fifty percent (50%) of the proceeds of retail sale of the Submission at the gallery less standard gallery commission and sales tax.
22. Third Prize Winner: The Third Prize winner will receive $500.00. Posters, t-shirts and buttons of artists winning submission will be sold and distributed on P.O.P to help raise money for the “Public Option”. A black and white version of the artwork will be posted on Sponsor’s website for free download. The original Submission will be made available for sale at an art gallery selected by POP. The winner will be entitled to retain fifty percent (50%) of the proceeds of retail sale of the Submission at the gallery less standard gallery commission and sales tax.
23. Public Choice Award: The Public Choice Award winner will receive $750.00. Posters, t-shirts and buttons of a The original Submission will be made available for sale at an art gallery selected by POP. Obligations of and Rights Granted by Persons Entering Submissions
24. By entering the Contest and uploading images of your Submission, you agree that, in the event your Submission is selected as a winning entry (First, Second or Third Prize or Public Choice) you are granting to Sponsor an exclusive, worldwide, royalty-free license to copy, reproduce, publicly display and publicly perform the Submission and any representation or image of the Submission in any medium; to use the Submission and any picture or representation of the Submission, in or on, and/or in connection with, the manufacture and sale by Sponsor of merchandise of any kind; to perform or display the entry publicly on Sponsor’s website, over the Internet, by means of a digital audio transmission and/or by any other means of broadcast, display and/or communication whatsoever; to modify the Submission and to publicly display and perform the Submission as modified and to use the Submission and any picture or representation of the Submission, as modified, in or on, and/or in connection with, the manufacture and sale by Sponsor of merchandise of any kind; and to create and reproduce derivative works based upon the Submission or any representation thereof without attribution or prior permission. Persons who are selected as winners will be required to complete a declaration, a license agreement reflecting the terms of the license set forth in this paragraph 24, and a publicity release and such other documents as may be required by the Sponsor to protect their rights and to use the Submission.
25. By entering the Contest and uploading images of your Submission, you agree that, in the event your Submission is selected as a winning entry (First, Second or Third Prize or Public Choice), you will make your Submission available for sale through a gallery selected by Sponsor in its sole discretion; that you will arrange for the physical shipment of the Submission, at Sponsor’s sole expense to such gallery; and that you will not be entitled to any payment or compensation whatsoever in consideration of the sale of the Submission other than one half of the proceeds of sale minus standard gallery commission and sales tax. In the event gallery, in Sponsor’s sole judgment, is unable to sell Submission after a reasonable period of time, Submission will be returned to the person entering it at Sponsor’s expense.
26. Acceptance of designation of your entry as a finalist or winner constitutes permission for Sponsor to use your name, hometown (including state) and/or your likeness for purposes of publicity about the Contest, promotion, advocacy communications and other noncommercial purposes, without further compensation to you or further permission from you.
27. By entering the Contest and uploading images of your Submission, you agree that, in the event your Submission is selected as a winning entry (First, Second or Third Prize or Public Choice), you agree that Sponsor, its officers, employees, consultants and agents, shall not be responsible or liable for, and shall be released and held harmless from (i) telephone, electronic, hardware or software program, network Internet or computer malfunctions or failures of any kind; (ii) any condition caused by events beyond the control of the Sponsor that may cause the contest to be disrupted; (iii) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from your participation in the contest or acceptance of designation as a finalist or winner, or arising from or based on the use, display or reproduction of your Submission by Sponsor or arising from claims based on publicity rights, defamation or invasion of privacy.
28. By entering the contest, you voluntarily and knowingly, release, discharge and relinquish any and all claims, actions and lawsuits of any kind against Sponsor, its officers, directors, employees, consultants and agents, related to or arising from your participation in the contest, including, without limitation, travel to and from any location used in connection with the Contest, the making, production, use, editing, distribution, licensing, promoting, and/or exhibition of the Submission including, without limitation, any claims, actions or lawsuits for wrongful death, negligence and/or other fault, either active or passive, personal injury, wrongful death, defamation, false light, violation of right of publicity, invasion of privacy, disclosure of embarrassing private facts, fraud, breach of contract, infringement of copyright, and negligent or intentional infliction of emotional distress. You acknowledge that you may hereafter discover claims in addition to the ones released in this document, and you hereby release Sponsor from any such unknown and/or unsuspected claims. You acknowledge and agree that this waiver is an essential and material term of your participation in the Contest and without such waiver you would be ineligible to participate in the Contest.
29. You agree that you shall have no right of approval, no claim to compensation or benefit, and no claim (including, without limitation, claims based upon invasion of privacy, copyright infringement, defamation, or right or publicity) arising out of any use or any editing, distortion, alteration, optical illusion, or use in partial or composite form of your Submission, whether or not intentional. Your participation in the contest is completely voluntary. There is no agreement between you and Sponsor of any kind express or implied, other than as set forth in these Contest rules. You are disclosing your Submission with the full understanding that no confidential or other relationship, fiduciary or otherwise, exists between you and Sponsor.
